Terms & Conditions

Entire Agreement:

This agreement contains the entire understanding between us and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing via email or direct message, signed by all parties. In the event that any part of this agreement is found to be invalid or unenforceable, the remainder of this agreement shall remain valid and enforceable. Any agreement to waive one or more provisions of this agreement or any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any other portion or provision of this agreement.

These Terms and Conditions are effective between the client and Jamie Shaw t/a Alchemy Wedding Films.

Event Schedule:

The client agrees to confirm the schedule at least one month prior to the event(s). Notification of any changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from us by you. Videographer will be attending for 10 hours (full day coverage).

Safety:

We reserve the right to terminate coverage and leave the location of the event(s) if the Videographer(s) experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the event(s); or in the event that the safety of the Videographer(s) is in question.

We hold personal liability insurance to protect us and the client from unforeseen incidents that damage our equipment. You will not be held accountable for any expenses incurred by any damages whilst filming at the event(s) unless the damage is caused by purposeful means with intent to damage the equipment.

Travel Expenses:

All travel expenses are based on the distance between the event location(s) and our starting address BB12. For all events, the first 50 miles roundtrip of travel are included. All miles in excess are charged at 0.75p per mile. This may not be applicable to you.

Responsibilities:

We are not responsible for compromised coverage due to causes beyond our control including but not limited to obtrusive guests, lateness of the client or guests, weather conditions, schedule complications, incorrect addresses provided to us, rendering of decorations, or restrictions of the locations. We are not responsible for backgrounds or lighting conditions which may negatively impact or restrict the video/photo coverage.

We are not responsible for any specific events that are not covered in your video and / or footage unless specifically requested on the pre-wedding meeting.

Limit of Liability:

In the unlikely event that the assigned videographer from us is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of us, we will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event, even non-refundable deposits.

In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond our control, including but not limited to camera, hard drive, or equipment malfunction, our liability is limited to the return of all payments received for the event(s). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. We are not liable for the loss of images beyond the lesser of the final delivery of all products included in the package.

Post Production & Editing:

The client understands that the final post production and editing styles, effects, and overall look of the videos are left to our discretion.

Model Release:

The client hereby assigns us the irrevocable and unrestricted right to use and publish videography of the client or in which the client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The client releases all claim to profits that may arise from use of the videography.

Delivery:

As set out on our initial wedding video package page we will deliver the following as separate videos to you on an Online Gallery via VidFlow/Vimeo:

  • Your Approx. 3-5 Minute Highlight Film

  • Your Ceremony

  • Any Speeches

  • First Dance*

Anything else must be requested on the pre-wedding meeting. We are not held accountable for any loss for non-requested footage / coverage. If any of the above are not present on your wedding day (i.e there are no speeches) we will not deliver any additional videos to replace this.

Standard delivery of all videos is approximately 8 weeks. This is not a guarantee. In some cases and during peak wedding season, this may be extended to around 12 weeks.

* This video may be edited in such a way that we create a ‘montage’ video of your first dance which collates all footage we capture overlayed with your first dance track. Some clips may be in slow motion and some may not.

Request of RAW Files:

We’re delighted to share with you the RAW files we shoot on the day. RAW files are clips anywhere from 1 second to 3 minutes long. The footage is from the video camera and is not a true representation of what your wedding video will look like on final delivery.

The RAW footage is not edited in any way. Clips may appear shaky, or with different colours and audio from that clip will be unedited. As we primarily shoot in slow motion, most clips will not include audio.

We offer the opportunity to buy the RAW files up to 6 months after your wedding at a fee of £395.00. We comply with GDPR and delete your footage unless requested to send.

Our footage cannot be edited in such a way to slander Alchemy Wedding Films. The footage can be shared an unlimited amount of times after the fee has been paid. We will provide you a complimentary USB / hard drive with all the footage and send out to you at no additional cost.

We are not held liable for any loss of coverage of, but not restricted to;

  • Specific venue coverage

  • missing guests

  • obstructed view by wedding guests

  • Unstabilised RAW footage

  • loss of audio, clarity of audio and/or loss of video coverage

Cancellation Policy:

For weddings and events, if for any reason the Client cancels up to 90 days before the wedding date, the Videographer will keep the the event retainer fee paid to hold the wedding or event date as a cancellation fee.

Cancellation must be made in sent in writing, by mail or e-mail. However, if the client requires to change the wedding date, we will strive to accommodate the change and no fee will be charged as long as the new date is available and within five months of the original event date. In the event that Alchemy Wedding Films is unavailable for the new date, the original contract will be cancelled and subject to the cancellation policy.

If the wedding or videography package is cancelled within 89 days prior to the event date, the full balance will be required to be paid for damages + any legal fees if progressed to court. If Alchemy Wedding Films cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Videographer’s illness or emergency, then the Videographer shall return the retainer fee to the Client but shall have no further liability with respect to the Contract.

This limitation on liability shall also apply in the event that video materials are damaged in processing, lost through camera or other media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the videographer.

Payment Terms:

We accept payment in a variety of different methods. Outlined are the methods of payment:

  • Bank Transfer

  • VISA Debit + Credit

  • Mastercard Debit + Credit

  • Cheque or cash

Refund Policy:

Due to the nature of digital videography and the fact that videos, once sent, cannot be returned; Alchemy Films has a strict no refunds policy. Once a transaction has been completed (i.e., the buyer selected and paid for the package and Alchemy Films has sent the buyer the correct videos) it is then considered non-refundable.

If in the unlikely event of legal action on either party and a full refund is requested in a court of law, the client accepts they will not retain any footage or deliverables from Alchemy Films, and agrees to return all videos and/or footage within 28 days.

Electronic Signatures are the same as handwritten signatures for the purpose of validity, enforceability and admissibility.
